About these terms
These terms apply to your use of this website and to every order you place through it. The website is operated by Fire & Ice Gemstone Jewellery Specialists Limited, trading as Fire and Ice, a family jewellery, pearl, essential oil and crystal shop at 6 Church Street, Akaroa 7520, New Zealand, trading since 1995. In these terms, “we” and “us” mean Fire & Ice Gemstone Jewellery Specialists Limited, and “you” means the person placing the order.
By placing an order you agree to these terms. Please read them before you check out. Nothing in these terms limits your rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or any other law that cannot be contracted out of.
Ordering and acceptance
Product listings on this website are an invitation to buy, not an offer. Your order is an offer to purchase. We accept your order when your payment succeeds and we send you an order confirmation email. That is the point at which a contract is formed between us. The Contract and Commercial Law Act 2017 governs the electronic steps in that process.
We may cancel an order and refund you in full where a product turns out to be unavailable, or where it was listed at an obvious pricing error. If that happens we will contact you to explain.
Please check the details in your confirmation email. If anything is wrong, contact us as soon as you can so we can correct it before the parcel is dispatched.
Pricing and payment
All prices are in New Zealand dollars and include GST. Prices may change at any time, but a change will not affect an order we have already accepted.
Payment is by credit or debit card through Stripe at checkout. Your card details are entered with Stripe and are not stored by us. Your order is processed once payment is successful.
Delivery
Online checkout currently ships to New Zealand addresses only. If you are in Australia or elsewhere overseas, please contact us for a freight quote and we will arrange your order directly.
Delivery within New Zealand is a $7 courier fee, and delivery and insurance are free on orders over $300. Full details are on our Shipping Info page.
Returns and faults
Our Returns Policy sets out how returns work. In short, contact us first, within 30 days of dispatch, and we will talk you through it.
If a product is faulty or is not as described, you have rights under the Consumer Guarantees Act 1993, including repair, replacement or a refund depending on the fault. Those rights sit alongside our returns policy and are not replaced by it.
Product descriptions and natural variation
We take care to describe each piece accurately, including its materials and dimensions. Natural gemstones, pearls and crystals vary in colour, pattern and size, so a piece may differ slightly from the images shown. Photographs are a guide rather than an exact match, and screens display colour differently.
Coupon codes
Only one coupon code may be used per order. Each code is subject to the conditions attached to it, including any minimum spend, product exclusions and expiry date. We may withdraw a code at any time.
Essential oils
Information about our essential oils is provided for general interest only. It is not medical advice and is not a substitute for advice from a doctor, pharmacist or other health professional. Follow the directions on the label, keep oils away from children, and stop use if you have a reaction. If you are pregnant, breastfeeding or taking medication, talk to your health professional before using essential oils.
Intellectual property
The content of this website, including the text, product photography, page design and the Fire and Ice logo, is our property and is protected by copyright and trade mark law. You may view and print pages for your own use. You may not copy, reproduce or republish any part of the site for commercial purposes without our written permission.
Liability
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or any other law that cannot be contracted out of.
Where you acquire goods from us for the purposes of a business, the Consumer Guarantees Act 1993 does not apply, and sections 9, 12A and 13 of the Fair Trading Act 1986 do not apply, to the extent the law allows that agreement.
Subject to the above, our liability in connection with an order is limited to the price you paid for the goods concerned, and we are not liable for indirect or consequential loss. We aim to keep this website available and accurate, but we do not warrant that it will be uninterrupted or error free.
Privacy
We handle your personal information in line with our Privacy Policy, which explains what we collect when you order and how we use it.
Changes to these terms
We may update these terms from time to time. The version published on this page when you place your order is the version that applies to that order.
Governing law
These terms are governed by New Zealand law, and the courts of New Zealand have jurisdiction, with proceedings usually brought in Canterbury.
